Synopsis: – Point of View is a compilation of articles written by advocate Asim Sarode in various newspapers in Maharashtra. These articles reflect his understanding of the various socio-legal issues in India. These articles are an effort to make India’s legal system more responsive and sensitive to the social justice problems faced by the people. Through these articles, Mr. Sarode has tried to make the people aware of their rights and to fight for them. The scope of these articles are vast and covers various issues like true democracy, the participation of the people in decision making at a primary level and problems faced by AIDS patients in India. These articles have the power to awaken the masses. Mr. Sarode has drawn in his vast experience as a lawyer, human rights activist and social worker. The author hopes that this book will act as a catalyst for social change.

Domestic Violence and Law

Synopsis: – This book has been written in the simplest language possible giving the right- based interpretation of the law. The Protection of Women from Domestic Violence Act (PWDVA) 2005 is landmark legislation; it indicates the constitutional promise of equality, non-discrimination, right to life and liberty for women. The author has written this book in interpretation mentioned, taking into consideration the norms and principles expressed in the Convention against Elimination All forms of Discrimination Against Women (CEDAW). The writer has also taken into consideration the law which is particularly relevant to our society where violence against women often enjoins socio-cultural sanction. This book is especially meant for victims of domestic violence, lawyers, judges, protection officers and to all men who want to bring the concept of violence-free society and family. This book can be of great use as an easy to use handbook.

बलात्काराची प्रकरणे हाताळताना

बलात्कारासंदर्भात सर्वत्र चर्चा सुरू असताना समाजातील प्रत्येक व्यक्तीने अत्याचाराला बळी पडलेल्या व्यक्तींसाठी काहीतरी सक्रियपणे करण्याची गरज आहे. कायद्याच्या क्षेत्रात कार्यरत वकील, सरकारी वकील, न्यायाधीश, पोलिस, साक्षीदार, तपासणी करणारे वैद्यकीय अधिकारी या सर्वांची जबाबदारी इतरांपेक्षा जास्त आहे. या पुस्तिकेचा मुख्य उद्देश बलात्कार म्हणजे काय, त्या संदर्भातील कायदा आणि न्यायव्यवस्थेतील प्रत्येकाने परिणामकारकपणे काम कसे करावे, या संदर्भातील दृष्टिकोन व्यापकवसंवेदनशील करणे हा आहे. भारतात अनेक महिला बलात्कारासारख्या अमानुष हिंसाचाराला बळी पडत असताना आज समाजात या गुन्ह्याबद्दल निर्माण झालेली घृणा, तसेच राग सकारात्मक कायदेशीर बदल घडवून आणण्यासाठी वापरणे म्हणजे बोजड व पुरुषप्रधान प्रक्रियेला प्रवाही करणे ठरेल, असा आमचा विश्वास आहे. फौजदारी न्याय यंत्रणा (Criminal Justice System) वकिलांसह इतर सर्वांच्या जिव्हाळ्याचा विषय झाला, तरच गुन्हेगारांना योग्य शिक्षा होताना दिसेल. स्त्रियांच्या शरीरावर केलेले राक्षसी आक्रमण म्हणून बलात्कार ही पुरुषांनी निर्माण केलेली सामाजिक समस्या पुरुषांनीच दूर करण्यासाठी पुढे आले पाहिजे. न्यायमूर्ती वर्मा समितीच्या सूचना स्वीकारल्या जातील, त्यानुसार बलात्कारासंदर्भातील कायद्यांमध्ये बदलही होतील. पण तोपर्यंत बसून बघत राहायचे नाही. आजही या घृणास्पद गुन्ह्याचा तडा लावण्यासाठी कायद्यातील अनेक मार्ग उपलब्ध आहेत, अद्याप वापरल्या न गेलेल्या तरतुदींचा अवलंब करणे शक्य आहे. सामाजिक न्यायासाठीचा आवाज ताकदवान करणे आपले कर्तव्य आहे.
